Part 1 of the 2019 Advanced Issues in Insurance Coverage includes sessions from the seminar that originally took place on the morning of 1/29/19 at the Akron Bar Association:
- Allocating Loss Among Multiple Implicated Policies
This presentation will address the limits to the all sums doctrine, battle of other insurance clauses and allocation issues.
- Beware the Trip Wires: How to Protect and Maximize Insurance Coverage Assets
This presentation will present real-world applications of key insurance coverage issues arising in commercial contexts. The topics explored will include: late notice; notice of circumstances; who is an insured clause; certificates of insurance; settlement allocation issues; consent to settle; deductibles and self-insured retentions; and reservation of rights letters.
- Insurance Coverage Issues in the Cannabis Industry
The disparate treatment of the legality of the cultivation, processing and sale of cannabis under state and federal law has resulted in coverage issues in the cannabis industry. Attendees will learn what the issues are, how they have been decided, and what the cannabis and insurance industries are doing to address them.
- Cyber Risks – The Oldest New Thing
This presentation examines the coverage available for cyber risks and discusses the seminal cases ruling on cyber issues.

Brouse McDowell
Lucas is a partner at Brouse McDowell practicing in the area of complex litigation. He has experience representing business clients in class-action lawsuits, policyholders in liability insurance recovery actions, and title insurance companies in disputes with financial institutions.
Previously, he served as an extern for the Honorable John R. Adams, for the U.S. District Court for the Northern District of Ohio. He was Executive Editor of the Akron Law Review, and an adjunct professor of Legal Analysis Research and Writing at University of Akron School of Law.
Lucas is certified as a Specialist in Insurance Coverage Law by the Ohio State Bar Association.

Daniel F. Gourash is the Director of the SSEG Tort Defense, Product Liability and Complex Litigation Division. In this capacity, he leads various trial and appellate teams in the efficient resolution of complex civil litigation spanning a variety of subject areas, including insurance coverage, toxic/mass torts, products liability, class action defense, business and personal defamation, and commercial and intellectual property disputes. Dan also advises companies regarding a variety of business strategies involving contracts, warranties, warnings and risk management.
Mr. Gourash received his B.A. from the University of New Haven summa cum laude in 1980 and his J.D. from Duke University School of Law in 1983. He has been active in the organized bar serving as Chair of the American Bar Association Young Lawyers Division 1993-94; Chair of the Lawyers Conference of the ABA Judicial Division 2005-06; Member of the ABA Trial Torts and Insurance Practice Section Counsel 2005-present; and Chair TTIPS Publication Editorial Board 2000-2005.
Dan has served as a member of the Board of Directors of the American Bar Foundation, the Rockwell Springs Trout Club, the Vestry and as Senior Warden of St. Peter’s Episcopal Church in Lakewood, Ohio and has been active in the Northeast Ohio Chapter of the Leukemia & Lymphoma Society.
